When something is everyone’s responsibility, it can end up being nobody’s. Legionella control is a good example. A clear owner, a clear plan and clear records make the difference between a water system that is managed and one that is hoped for.

Who is responsible?

Employers and those in control of premises have duties to manage risks to health. Under the Safety, Health and Welfare at Work Act 2005, that includes risks that may arise from a building’s water system. In a lease, shared building or managed property, responsibilities may be divided between owner, landlord, managing agent and tenant, so it is worth being clear who does what.

Roles that help

  • Duty holder: the person or organisation with overall responsibility.
  • Responsible person or water safety lead: the person who oversees day-to-day control, such as flushing, temperature checks and records. Typical practice is to name a deputy too.
  • Competent adviser: a legionella specialist who carries out risk assessments, sampling and advice.
  • Contractors: plumbers, maintenance teams and water treatment providers.

What a clear arrangement looks like

  • A written scheme setting out what is checked, how often and by whom.
  • Named people with clear tasks and enough time to do them.
  • Instruction and awareness so those who carry out checks know what to do and what to report.
  • A logbook that is kept up to date. See our legionella logbook guide.
  • Review dates for the risk assessment and after any changes to the building or use.
  • Handover plans for when someone leaves or a contract changes.

Managed and shared buildings

In apartment blocks, multi-tenant offices and similar buildings, agree in writing who is responsible for shared tanks, pipework and plant. See our guide to legionella in apartment blocks and managed buildings.

Guidance to follow

The HPSC national guidelines for the control of legionellosis in Ireland give practical advice on roles and routines.
